In the UK a pizzeria with tables and a pizza takeaway are not the same thing in planning law. One sits inside Use Class E, the other is sui generis and needs permission in its own right. That distinction shapes the site search, the licensing, the trading hours and the budget. What follows sets out the process in England, and flags where the other nations differ.<\/strong><\/p>\n\n\n\n

Pizza sits across three regulated activities. It is a food business, so it registers with the local authority. It is a hot food operation, so planning treats it differently from a caf\u00e9. And it commonly trades after 11 pm, which makes it licensable under the Licensing Act 2003 whether or not alcohol is sold. A pizzeria can clear the first and fail the other two, which is why the sequence below starts with the use class.<\/p>\n\n\n\n

What is a pizzeria business?<\/h2>\n\n\n\n

A pizzeria is a food business selling pizza for consumption on the premises, for collection or for delivery. UK planning law does not recognise the word, and classifies premises by where the food is eaten. A pizza restaurant, where consumption is mostly undertaken on the premises<\/strong>, falls within Use Class E(b)<\/strong>. A pizza takeaway, where consumption is mostly undertaken off the premises<\/strong>, is sui generis, outside every use class, under the Use Classes amendment in force since 1 September 2020. Settle the format and the split of trade<\/h3>\n\n\n\n

Four formats dominate: the sit-down pizza restaurant, the collection and delivery takeaway, the delivery-led kitchen with no shopfront, and the mobile oven. The choice sets the use class, the licensable hours and the size of the unit. Operators who expect delivery to grow from a sideline into the majority of turnover are describing a change of use, not a change of emphasis.<\/p>\n\n\n\n

Check the planning position before signing anything<\/h3>\n\n\n\n

An existing Class E unit carries no right to run a pizza takeaway. Moving to sui generis requires a planning application, and so does most external work: the flue, the ducting and any shopfront alteration. Government health guidance encourages councils to use planning controls on hot food takeaways, and many operate supplementary planning documents restricting new units near schools, so refusal is a live possibility rather than a formality.<\/p>\n\n\n\n

Research the catchment and the delivery radius<\/h3>\n\n\n\n

Pizza is an evening and weekend trade, so catchment work centres on residential density and the drive time to the edge of the delivery area rather than daytime footfall. A delivery-led site can take a cheaper secondary unit because nobody has to walk past it. A sit-down pizzeria cannot.<\/p>\n\n\n\n

Write the business plan<\/h3>\n\n\n\n

A business plan is normally the first document a lender asks for, and in pizza it turns on the split between counter, collection and delivery. Delivery through an aggregator gives away a share of every order in commission, which changes the arithmetic of a discounted menu. Occupancy is the other pressure point, since rent, service charge and business rates are three separate charges.<\/p>\n\n\n\n

Choose a structure and register the business<\/h3>\n\n\n\n

A sole trader<\/strong> registers for Self Assessment with HMRC. A private company limited by shares<\/strong> is incorporated at Companies House, with directors carrying statutory duties under the Companies Act 2006 and now verifying their identity. A PAYE scheme follows before the first payday, and VAT registration once taxable turnover passes \u00a390,000<\/strong>. Hot food is standard-rated at 20% whether eaten in or taken away, so a pizzeria has none of the zero-rating a bakery works with.<\/p>\n\n\n\n

Arrange the funding<\/h3>\n\n\n\n

Funding usually combines own capital with a commercial loan, and asset finance is common on the oven and refrigeration. Start Up Loans<\/strong>, run by a British Business Bank subsidiary, lends up to \u00a325,000<\/strong> per applicant at a fixed 7.5%<\/strong> over one to five years, unsecured, to a maximum of \u00a3100,000 per business. The British Business Bank’s guidance indicates that with an established franchise brand the franchisee will need at least 30% of total set-up costs, including working capital, from their own funds.<\/p>\n\n\n\n

Find a site and negotiate the lease<\/h3>\n\n\n\n

UK commercial leases carry no statutory term structure and no automatic renewal right, so the term, the reviews and the exit are all negotiated. Most small units are let on a fully repairing and insuring<\/strong> basis, putting the repairing obligation on the tenant and creating a dilapidations liability at expiry.<\/p>\n\n\n\n
